This document governs the use of Hardy Rifle Engineering’s online service (the service) including shopping and participation in promotions run by Hardy Rifle Engineering (Hardy Rifle). The Hardy Rifle website is owned by Hardy Rifle Engineering Limited.

By accessing, browsing or using this site, you acknowledge and agree to the terms and conditions, as well as any relevant disclaimers contained herein. Further, by continuing, you acknowledge that you have read, understood and accepted these terms and conditions. By purchasing a product from this website, you agree to be bound by these terms and conditions.
Hardy Rifle reserves the right to change any or all of the information contained herein at any time and you should check the current terms and conditions in order to obtain the most up-to-date information prior to purchasing any item from this website or participating in any website promotion by Hardy Rifle. Hardy Rifle reserves the right to refuse service, remove or edit content or cancel orders at their sole discretion. Any orders cancelled by Hardy Rifle that have been paid for, will receive a full refund.

To purchase from this site, you must be eighteen (18) years of age or over (younger customers or those without a credit card can make alternative purchasing arrangements by contacting our retail stores direct. To purchase a firearm you are required to be eighteen (18) years of age or over and hold a current New Zealand Firearms License.
Pricing
All prices are shown in New Zealand dollars (NZ$) and include GST (which is currently 15% sales tax). Hardy Rifle reserves the right to amend our prices accordingly, should the current GST amount change. All prices are correct at the time of publication however we reserve the right to alter prices at any time and for any reason. If this should happen after you order a product, we will contact you prior to processing your order.
International site visitors
Online purchases via the website www.hardyrifle.co.nz are only for items being shipped to an New Zealand address. International purchases require export permits and other relevant documentation and procedures to be fulfilled. Please contact us if you are wanting to purchase an item from us that you intend to have shipped overseas. While this is not always an option, we do have global resellers who we do export to, that may stock, or be able to source, the product you require on your behalf.
Security
When you purchase using our secure online credit card facility, you can be confident that all of your details are protected by the latest security mechanisms and are used only for the purpose of fulfilling the transaction. Your information will not be shared with any third party other than those required to facilitate the transaction such as our banking merchant and payment gateway provider whom are legally bound by strict privacy terms and conditions.
Errors and Omissions
Hardy Rifle are not responsible for any inaccuracies and typographical errors contained within this website. The information, prices, discounts and promotions are subject to change without notice. If there any changes after you have ordered a product, we will contact you prior to processing your order.
Coupon codes
Coupon codes can only be used for the product and manner intended by Hardy Rifle. If a coupon code is used on a product not intended to be on sale but the coupon is accepted by the website in error, the sale may not be fulfilled and any paid funds refunded.

Please ensure you do not knowingly transmit any material that may contain a virus or other harmful component. Only individuals who can make legally binding contracts may purchase goods and services from this site. Hardy Rifle cannot guarantee that it will notice or be able to prevent any illegal or inappropriate use of this website, nor can Hardy Rifle guarantee that it will give notice of any illegal or inappropriate use of this website.

When you visit our websites, www.hardyrifle.co.nz or www.hardyrifle.com, or send emails to us, you are electronically communicating with us. By doing so you consent to receive communications from us electronically. We will communicate with you by e-mail or when practicable, by phone.
Online Orders
By placing an order on this website you agree to, and accept the terms and pricing specified on this website. These prices may include additional delivery and other applicable charges. Your order may be accepted or rejected by Hardy Rifle for any reason, including, the unavailability of any product, an error in the price or the product description posted on this website, or an error in your order. Your contract with Hardy Rifle will only come into existence when you have fully paid for your order and Hardy Rifle provides confirmation that your order has been accepted. Confirmation will be sent via email to your elected email address. Online orders purchasing any non-prohibited firearms parts and not collected in person at our facility, are required to be approved by the New Zealand Police. Please see Online Purchase Police Procedure below for full details.
Online Purchase Police Procedure
The mail order or Internet sales form is required where arms items (excluding prohibited parts) are being sold and purchased without in-person completion of the sale. This is in accordance with Section 43A(1) and (2) of the Arms Act 1983. This legislation is current, as far as we are aware, however may be changed at any time and without notice. In completing a transaction to purchase a non-prohibited firearm product from our website, you agree to undertake all necessary steps to fulfill your obligation in receiving approval by the New Zealand Police to take possession of the proposed item/s. Hardy Rifle will not be held liable for applications that have been denied by the New Zealand Police, nor will Hardy Rifle be held liable by the New Zealand Police, or any other authority, for any unlawful activity by you, the purchaser.
Upon receipt from the New Zealand Police of an application having been approved, Hardy Rifle will continue to process the order and despatch it to you accordingly and within a timely manner (please see our Delivery policy below). Please note that some custom orders may not be placed into production until approval has been received and therefore some delays are possible. It is your responsibility as the purchaser to ensure prior to any purchase on our website that you are legally entitled to take possession of an item/s you propose to purchase. In the event that your application is denied by the New Zealand Police, a refund of the purchase price (paid) including any associated shipping cost (less an administration fee of $25), will apply for stock items only. For items that are made to order or customised, all sales are final and no refund will apply, unless, in the event that an order for a customised item has not yet gone into production, Hardy Rifle will at their discretion approve a refund on a case by case basis.
Returns & Refunds
Please contact us for clarification, prior to purchasing, if you are unsure on any aspect of a product or do not understand the policies within our Terms and Conditions. If for any reason you wish to return a product you have purchased, please notify us within 5 days of receipt of the product/s. This is exclusive of custom and non-stock items. Non-stock or custom-made products cannot be cancelled once ordered and are non-returnable and non-exchangeable. All sales are final on such products and full payment is required before we place orders with our suppliers. Once an order is processed, unfortunately no changes may be made.
If we agree that you can return the items, a restocking fee of $25 will apply.
To be eligible for a return, the item must be in its original condition, unused and in it’s original packaging. We cannot accept goods in damaged packaging unless the goods are faulty. We will either exchange, replace, provide a store credit, or refund the purchase price at our discretion excluding any shipping charge if the product is not faulty.
Please email accounts@hardyrifle.co.nz to notify us of your wish to return an item. Ensure that you include the invoice number on the email and your reason for returning it. Please advise whether you would like to exchange it for another product or request a refund. Please wait for our acknowledgement before returning any items.
Refund procedure (where applicable) - Once a return is received and inspected, Hardy Rifle will notify you by email the approval or rejection of the refund request. If approved, the refund will be processed and credited to your credit card or original payment method within 14 days.
Replacements procedure (where applicable) – Items will only be replaced if they are deemed defective or damaged through no fault of you, the purchaser. If an exchange is required, please email accounts@hardyrifle.co.nz. Unless the product is faulty, you will be responsible for paying associated shipping costs to return the product. Shipping costs are non-refundable, except in the event the product is faulty, in which case Hardy Rifle will credit the purchaser any applicable shipping costs.
Until the returned items have been received by Hardy Rifle, the products remain the responsibility of the purchaser. Courier tracking is recommended for any item returned to us. Hardy Rifle will not be held liable for any item damaged or lost during shipping.
Force Majeure
No party shall be liable or responsible to the other party, nor be deemed to have defaulted under or breached any online sale or purchase contract, for any failure or delay in fulfilling or performing any term of an online sale or purchase contract (except for any obligations to make payments to the other party hereunder), when and to the extent such failure or delay is caused by or results from acts beyond the impacted party’s (“Impacted Party”) control, including, but not limited to, the following force majeure events (“Force Majeure Events”): (a) acts of God; (b) a natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms, explosions, infestations), epidemic, or pandemic; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of this Agreement; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labour stoppages or slowdowns or other industrial disturbances; and (i) shortage of adequate power or transportation facilities. The Impacted Party shall give Notice within 5 (five) days of the Force Majeure Event to the other party, stating the period of time the occurrence is expected to continue. The Impacted Party shall use diligent efforts to end the failure or delay and ensure the effects of such Force Majeure Event are minimized. The Impacted Party shall resume the performance of its obligations as soon as reasonably practicable after the removal of the cause. In the event that the Impacted Party’s failure or delay remains uncured for a period of sixty (60) days following Notice given by it, the other party may thereafter terminate this Agreement upon Notice.
Fraud Protection
As part of our order processing procedures and as a measure to protect our customers as well as ourselves, we screen all received orders for fraud or other types of unauthorised or illegal activity. We reserve the right to refuse to process an order due to suspected fraud or unauthorised or illegal activity. If such is the case, we may reject your order or we may contact you at the phone number provided by you to confirm your order. We also reserve the right to cancel any accounts or refuse to ship to certain addresses due to suspected fraud or unauthorised or illegal activity.
Risk
Hardy Rifle will retain ownership of the products you order until you have made payment in full for those products, but all risk in the products will pass to you on dispatch from the Hardy Rifle premises or supplier which is supplying your order.
Loss or damage in transit
Hardy Rifle will take every care in packing and dispatching your purchase but is not responsible to the buyer or any person claiming through the buyer for any loss or damage to goods or products caused by any event of any kind by any person, whether or not Hardy Rifle is responsible for the person who caused or contributed to that loss. Hardy Rifle is not responsible for any loss of items that are wrongfully signed for and accepted by a third party.
Exclusion of Negligence
Hardy Rifle is not liable to the buyer in contract or in tort arising out of, or in connection with, or relating to:
1. the performance of the product;
2. any fact, matter or thing relating to the products; or
3. any error in information supplied to the buyer or a user at or after the date of the purchaser’s or user’s use of the product.
Delivery
Your order will be dispatched from Hardy Rifle provided we have received the necessary approval from the New Zealand Police (where applicable) and, provided the items to fulfil your order are in stock. If we do not, we will contact you, the buyer, and inform you of the estimated date of availability. If you, the buyer, aren’t satisfied with the proposed timeline, Hardy Rifle will provide a refund of the money paid for that order.
Delivery times given on this website are indicative only. Hardy Rifle will not be liable for any failure to observe specified delivery times but will try and contact you by phone or email if any late deliveries are anticipated. You understand and agree that you shall not be entitled to withdraw or modify any commitment made for the purchase of products from this website once that commitment has been made for any reason, including without limitation, due to any delay in delivery.
Termination
Your ability to purchase products and services from this website may be terminated at any time by Hardy Rifle without notice. All disclaimers and limitations of liability by Hardy Rifle will survive termination. Should you object to any of these terms and conditions, including any subsequent amendments, you must immediately discontinue use of this site.
Third party advertising, hyperlinks and offers
The site may have third party advertisements, referral buttons and other pointers to website operated by third parties. Hardy Rifle has no control over these sites and is therefore not responsible for any materials and content linked to our website. While this information is offered in good faith, it must be understood that Hardy Rifle does not endorse any of these sites or their advertising and is not responsible for any goods you purchase from them.
Colour information
While Hardy Rifle has endeavoured to accurately display the colour of products, the actual colours you see will depend on your monitor and may not be accurate.
Product Descriptions
Hardy Rifle and its suppliers attempt to be as accurate as possible in describing products detailed on the site www.hardyrifle.co.nz / www.hardyrifle.com. However, Hardy Rifle does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Hardy Rifle is not as described, your sole remedy is to return it in an unused condition, in original packaging, for refund of the purchase price. The cost to return courier these products to us will be at your expense.
Governing Law
The laws of New Zealand govern any contract arising out of this website, and all disclaimers, terms and conditions and terms of use.
